The trade-related aspects of intellectual property rights (TRIPS) which was adopted in 1994 in Uruguay in the General Agreement on Tariffs and Trade (GATT) in 1994. The TRIPS Agreement has been followed by the World Trade Organization (WTO). The latter sets minimum intellectual property rights. Al Like other rights (ie: the right to health), this right is actually protected by numerous international instruments. One of the international instruments recognize the right to health is the Covenant International Covenant on Economic, Social and Cultural Rights (ICESCR), which refers to the obligation to respect (to avoid interference with the enjoyment of that right), protect (required to take steps to prevent third parties from interfering with his right) and meet (required to take positive measures to fulfill its obligation). Aware of the difficulties real too rigid application of the Covenant, the Committee on Economic, Social and Cultural Rights (CESCR), which only requires a State to develop using the maximum of resources, but there is currently no effective monitoring. Moreover, the TRIPS Agreement relates to the countries that are part of the GATT in order to fulfill more effectively the intellectual property rights. Many developed countries not approve the TRIPS Agreement if any other matter has not been previously resolved because it is a major  'award already. However, the U.S. has required a special treatment that the TRIPS Agreement. In addition, the TRIPS Agreement effectively protect the patent holder, IES 27 states that allow only of a country to exclude from patentability if it is a matter of public safety or morals, but this is only if no other option available. We even see the importance of this treaty in other terms used in it to say "national emergency", "anticompetitive practices" … But some of these expressions are without clear definitions in international law.

That said, it is clear that one can foresee that the best is that patent protection is the highest is the price of AIDS drugs will be. However, many AIDS drugs were developed before the TRIPS Agreement therefore not protected by this agreement. For those who are really protected, some say (most of the pharmaceutical companies), that patent protection is a necessity for have the money spent for research and allow a pharmaceutical company further research, I do not buy this argument explaining often it is governments that actually pays for most of the investigations. In fact, with a program such as Scientific Research and Experimental Development (SR & ED) tax credit given by the government, this is a very interesting incentive for scientific research no reimbursement for all (100%) fees for Scientific Research!

At the hearing on both issues, the impact of strict implementation of TRIPS with respect to appropriate salary and concludes that not be linked between wages and the amount of pharmaceutical companies can retain. Wojahn then continues, to name a few alternatives solution to the conflicts of both the rights and price controls (but this costs a lot to manage and create tension), health insurance (most of them only covers up t0 50% and also require a lot of funding), and direct donations and purchases in bulk (no additional costs associated with gift or donation that are impeding the development of a generic product in the county and there is not much lower prices).

Finally, under the Convention Vienna provides in art 31 that a treaty must be interpreted in good faith. Speaking of interpretations, the first is to look at all the TRIPS Agreement. Another way to interpret a treaty and to further enforce the recognition of the right to health as an international customs. It is also mentioned as the ICESCR, where 143 countries are actually members, adding another way to more effectively enforce the right to health.
